This week's CodeMap® Compliance Briefing discusses the prohibition of offering inducements to Medicare beneficiaries. Most of our subscribers understand federal anti-kickback provisions that prohibit providers from offering remuneration to other providers in exchange for the referral of Medicare and/or Medicaid beneficiaries. However, many providers are less likely to fully understand similar provisions that disallow the offering and/or provision of remuneration directly to the beneficiaries of these programs. The following briefing explains the origins and elements of these beneficiary inducement provisions, as well as explores applicable OIG guidance.
