As promised at the July 2012 fact finding meeting, CMS has issued its preliminary payment determinations for the new test codes included in the 2013 Medicare Clinical Laboratory Fee Schedule (CLFS). We had anticipated that this announcement would provide the first indications of how CMS intends to answer two important questions concerning the over 100 new molecular pathology codes. The first question being, will CMS place the codes on the CLFS or the Medicare Physician Fee Schedule (PFS)? The second, and just as important, question being will CMS crosswalk the codes to existing codes, use a gap-filling process, or utilize the RBRVS system to determine payment for these codes.
