As we have reported numerous times this year, CMS is using gapfilling methodology to set payments for molecular pathology CPT codes on the Medicare Clinical Laboratory Fee Schedule. The gapfilling process requires CMS to consider comments received regarding the preliminary fees from individual Medicare contractors that were posted on the CMS website earlier this year. With these comments in mind, CMS must then develop and post proposed payment rates using a broad range of information outlined in applicable regulations. CMS posted these proposed payment amounts on September 30, just before the government shutdown.
