This week's CodeMap® Radiology Briefing will explore the compliance issues of providing discounts to financially needy patients. This issue may be more relevant than ever considering the prolonged recovery of our nation's economy, and the financial hardships that many patients continue to face.
The latest OIG guidance on offering discounts to patients comes from the June 24, 2004, testimony of the Chief Counsel to the Inspector General before Congress concerning discounts and compliance with federal rules and regulations. In particular, this testimony concerned compliance with the Federal Anti-Kickback Statute, the OIG's exclusion authority prohibiting excessive charges, and the Civil Monetary Penalties provisions that prohibit inducements to Medicare and Medicaid beneficiaries. This week, we will examine all these provisions and how they affect a provider's ability to offer discounts to patients who cannot afford to pay for their care.
